Summary
A second federal judge has ruled that New York's climate superfund law is unconstitutional and blocked it. U.S. District Court Judge P. Kevin Castel held that the Department of Justice has standing to argue the law impinges on federal sovereign authority to regulate and enforce greenhouse gas emissions and on federal interests in foreign affairs. The first ruling came from Judge Brenda Sannes, who sided with 22 Republican-led states' attorneys general in declaring the law unenforceable. The law required fossil fuel companies to pay up to $75 billion into a state fund. The Justice Department argued it unreasonably burdens domestic energy development and raises energy costs for New York residents.
