Signal Supreme Court permits DHS to use modified SAVE program to verify voter citizenship
Summary
The U.S. Supreme Court ruled 6-3 on 25 September 2026 in Department of Homeland Security v. League of Women Voters. The decision lets DHS keep using its modified Systematic Alien Verification for Entitlements (SAVE) program to check the citizenship of voters. It stays a 22 June 2026 order of the U.S. District Court for the District of Columbia that had tried to halt the system. DHS links the program to Executive Order 14248 on election integrity, signed in March 2025. DHS General Counsel James Percival called the ruling a victory for election integrity. Reports say the tool has mistakenly flagged some eligible voters as possible noncitizens, and Justice Jackson, joined by Justices Sotomayor and Kagan, dissented over the harms it causes.
