China's Ecological and Environmental Code officially took effect on August 15, 2026, according to Xinhua, after being adopted by the National People's Congress on March 12, 2026; it is China's second piece of legislation formally designated a 'Code,' after the Civil Code. The Code comprises 1,242 articles across five chapters covering pollution control, ecological protection and green, low-carbon development, consolidating more than 30 environmental laws, over 100 administrative regulations and more than 1,000 local rules, and repealing 10 existing environmental laws including the Environmental Protection Law. A key provision, Article 1236, replaces percentage-of-damage fines under the former Marine Environmental Protection Law with a fixed fine structure, ranging from RMB 300,000-1,000,000 for base-level violations up to RMB 10,000,000-20,000,000 for extraordinary incidents, with particularly serious cases subject to fines two to five times those amounts. The Code's effective date coincided with China's fourth National Ecology Day, observed under the theme 'Building a green foundation for Chinese modernization.' It follows China's 15th Five-Year Plan, introduced in March 2026, and a July 2026 State Council plan for building a 'Beautiful China' during 2026-2030.
